📌 When to Use▾
Use for ALL residential property sales in Florida — single-family, condo, townhome, or multi-family up to 4 units. Seller makes no repairs — buyer accepts property in its current condition. Most common contract used by FL Realtors.
📝 Complete In This Order▾

Par. 1 — Property
Address + legal description. Must match title commitment exactly.

Par. 2 — Purchase Price
Full price + financing type (cash, conventional, FHA, VA, other).

Par. 3 — EMD & Escrow
Amount + escrow agent name. Due within 3 business days of effective date.

Par. 5 — Closing Date
Typically 30-45 days for conventional, 45-60 days for FHA/VA.

Par. 12 — Inspection Period
Default 15 days. Buyer must send written cancellation before it expires or right is waived.

Par. 9 — Flood & Liens
Flood zone status, municipal lien search. Seller pays. Order early — 5-10 days.

Par. 18 — HOA Docs
Condo/HOA docs delivery + 3-day buyer right to cancel (F.S. 718.503).

Effective date = date of LAST signature. All deadlines run from here.
💡 Agent Tips▾
Effective Date Rule
The effective date is the date the LAST party signs — not when the offer was made. All deadlines (EMD, inspection, loan commitment, closing) run from this date.
EMD — 3 Business Day Rule
Business days = Mon–Fri excluding FL public holidays. Failure to deposit on time is a FREC violation (F.A.C. 61J2-14.010). Get it in escrow immediately.
Inspection Period Notice
Buyer must deliver written notice to cancel BEFORE the period expires — not on the last day, BEFORE midnight. Calendar days, not business days. Set a calendar reminder.
AS-IS Means AS-IS
Seller makes zero repairs. Buyer can request repairs but seller is under no obligation. Buyer's only remedy is to cancel during the inspection period.
⚠️ Watch Out For▾
Legal description must match title commitment exactly — any mismatch can delay or kill the deal
FD-1 Flood Disclosure must be signed BEFORE contract (F.S. 689.302) — not after
Lead-Based Paint disclosure required for any home built before 1978 — federal law, no exceptions
HOA estoppel letter — request early, can take 10+ business days and costs $100–$300
Municipal lien search — seller pays, order early (5-10 business days per municipality)
Both parties must initial every page and sign/date the signature page
Keep signed copy 5 years per F.S. 475.5015
